This page is for people who buy an e-gata subscription as an individual, not through a company. In short: what you get, what you pay and what rights you have. The complete rules are in the Terms and Conditions, Article 21.

Who is selling

What you are buying

A monthly subscription that includes the website, hosting, configuration of your domain, the SSL certificate and a professional email address, plus, depending on the package, creation of social media accounts, 8 posts per month on Facebook, Instagram and TikTok, management of the Google Business Profile, of Meta ads, a chatbot and, on the Growth package, a CRM for enquiries from your contact form. What you pay (VAT included)

• Prices include VAT. There are no other charges payable to us: no setup fee, no payment fee.
• You pay monthly, in advance, on the basis of a pro forma invoice you receive by email, by bank transfer, in lei, at the National Bank of Romania (BNR) rate of the day the pro forma invoice is issued, as applied by SmartBill and shown on the pro forma invoice, stating the series and number of the pro forma invoice in the payment details. Each party bears its own bank's charges. We do not offer discounts for the minimum term or for paying for several months.
• On the Growth package, the Meta advertising budget is not included; you pay it directly to Meta.
• You buy and pay for the domain yourself, at a registrar of your choice (about €12 per year for .ro or .eu; the price is set by the registrar). It is not included in the subscription.
• No automatic charging. We never take money unless you pay.

The minimum term: 12, 6 or 3 months

• Every package has a minimum term, counted from the publication of the website: Presence 12 months, Complete 6 months, Growth 3 months. You commit to paying the monthly fees for that period, one per month. You do not pay for the term in advance and there is no termination penalty.
• The monthly price does not increase during the minimum term.
• You can cancel at any time, but a cancellation made during the minimum term takes effect at the end of the minimum term; until then the services in the package work normally, and the monthly fees are paid as usual.
• You leave without owing the remaining months if you withdraw within 14 days of payment, if you use the 14-day guarantee after publication, if we fail to meet our obligations or the service is not in conformity, or if we change the Terms or the service to your detriment and you do not agree.
• If you stop paying, we suspend and then close the subscription; you owe only the fees for the months in which you received the service.
• After the minimum term, the subscription continues monthly, with no new commitment, and you can cancel it at any time, effective at the end of the paid month. We email you at least 30 days before the minimum term ends.
• If you change package, the months already paid count, but the current minimum term is not shortened (Terms, Article 8.10).

The contract is concluded on the day we receive the first payment. When ordering, you can ask us, by an optional box, to start immediately: we then usually publish the website within 48 working hours of payment being confirmed and of you giving us access to the domain. If you do not tick it, we start after the 14 days during which you can withdraw. The first subscription month begins on the day of publication, so you do not pay for the waiting days.

Your right of withdrawal: 14 days

• You can withdraw from the contract within 14 days of its conclusion (the day of payment), without saying why.
• The simplest way: the “Withdraw from the contract here” link in the footer of every page. You immediately receive a confirmation by email. You can also write to contact@e-gata.ro or use the withdrawal form.
• We refund you within no more than 14 days, to the same account you paid from, with no fee.
• If you asked us to start immediately and you withdraw within these 14 days, the law allows us to keep an amount proportionate to the days of service received in the paid month. Through our 14-day guarantee we waive it if you ask within the first 14 days after the website is published (once per person).
• Withdrawal ends the whole contract, including the minimum term: you do not owe the remaining months.

Our “14 days satisfied or your money back” guarantee

Within the first 14 days after the website is published, we refund the amount paid in full, on simple request, without a reason. Once per client. The contract ends, including the minimum term.

How it differs from the statutory right of withdrawal:

The guarantee is in addition to your statutory rights and does not limit them. When both apply, we use the option that is better for you.

Cancellation

You can cancel at any time, using the “Withdraw from the contract here” link or by email. A cancellation made during the minimum term (12 months on Presence, 6 months on Complete, 3 months on Growth) takes effect at the end of the minimum term (see above); after that, at the end of the month already paid. Until then everything works normally, with no penalties.

The legal guarantee of conformity

For the digital services in the subscription (the website as an online service, hosting, email) you have the legal guarantee of conformity (Government Emergency Ordinance No. 141/2021) throughout the contract. If something does not work as promised, we fix it; if we cannot do so within a reasonable time, you are entitled to a price reduction or to terminate the contract, with a refund for the remaining period. For services performed by people (social media, ads) we are liable under the Civil Code.

Your domain and your data

• You buy the domain (.ro or .eu) in your name, at a registrar of your choice, and you pay for and renew it yourself (about €12 per year). It remains yours after the contract ends.
• To publish the website and configure email, you give us access to the domain's DNS (we send you the steps). We do not ask for the password of your registrar account.
• Make sure you renew the domain on time. If it expires, the website and email stop working until you renew it; we then restore them within no more than 48 working hours.
• We do not ask for your personal identification number (CNP). You give the domain details directly to the registrar.

If you set up a company later

You can ask at any time, by email to contact@e-gata.ro, for the subscription to be moved to your company (SRL, PFA, II, IF). The month already paid continues as before; subsequent pro forma invoices are issued to the company, at business prices (+ VAT). The current minimum term continues, without a new one starting. You change the domain holder yourself, at the registrar; we update the configuration, if needed, at no cost. Details: Terms, Article 8.8.

Complaints, ANPC and alternative dispute resolution (ADR / SAL)

1. Write to us at contact@e-gata.ro. We reply within no more than 5 working days.
2. If you are not satisfied with the reply, you can contact the National Authority for Consumer Protection (ANPC), including through the alternative dispute resolution (SAL) procedure: reclamatiisal.anpc.ro. We are willing to take part in ADR procedures.
3. You can also go to the court of your place of residence at any time.
